We are pleased to receive payment for annual memberships of the Mind Tools Club by:

(We regret that the cost of currency conversion and transaction processing makes it impractical to process these types of payment on a monthly basis and so monthly payments can only be taken by credit/debit card. If you wish to pay monthly, but do not have a card, we are sorry that it will not be possible for you to join the Club.)

Terms & Conditions of Service

1. Contract Terms

These terms govern our provision and your use of the Mind Tools Club™ online service ("the Service"). Please read them carefully.

We provide the Service only in accordance with these terms and if you do not agree to be bound by the following terms you may not use the Service. By ticking the check box on the bottom of this page accepting these terms and conditions you will be deemed to accept the following terms.

We care very much about the standard of the Service, and we want to hear from you if you are not satisfied in any way. If so, please contact customer.helpdesk@mindtools.com to email us or call our customer services team on +44 20 7788 7978.

2. Our obligations

2.1 We will provide you with the rights to use the Service. These rights will depend on the form of the membership that you have chosen to open with us.

2.2 We will observe all relevant UK data protection legislation in relation to the data you provide to us on registration and will only use it for authorised purposes. Please see our Privacy Policy for more information on this.

We will provide the Service to you with reasonable care and skill and will use our reasonable endeavours to maintain continuity of Service. However, we cannot guarantee that the Service will be continuous or error free.

We do not accept liability for any special loss or any indirect or consequential loss of any nature (including without limitation any economic loss or other loss of business, production, revenue, profit, goodwill or anticipated savings), whether arising in contract, tort, negligence, breach of statutory duty or otherwise, and whether or not the possibility of such loss arising has been brought to our attention.

2.3 We may not monitor those portions of the Service which are generated by other users of the Service (for example, members' forum postings) but we reserve the right to do so. We take no responsibility for material that has not been introduced by us.

You acknowledge that you are solely responsible for the form, content and accuracy of any material introduced by you and that your use of any forum associated with the Service will comply with our forum code of conduct (see below). We reserve the right to suspend or terminate our provision to you of the Service if you do not comply with our forum code of conduct.

2.4 Whilst we take all reasonable care in providing the Service, any contract you may make with others through the service is entered into at your own risk and we make no representation as to whether you will be satisfied with what others provide to you.

3. Payment

3.1. Unless otherwise stated, the subscription fees for the Service will be $1 USD for the first month. The subscription fees for subsequent months will be $19 for standard membership or $27 USD per month for premium membership.

3.2 Unless agreed otherwise, all our charges are inclusive of any applicable value added or other tax.

3.3 We reserve the right to suspend our provision to you of the Service or terminate the contract between us if our charges are overdue for payment by you.

4. Cancellation Right & Money Back Guarantee

4.1 You may cancel your subscription to the Service at any time. If you cancel, you will receive a refund of the subscription fees paid for the month in which you cancel your subscription.

4.2 To cancel your subscription and claim a refund, please send an email to our customer services team at customer.helpdesk@mindtools.com. We will issue the refund within 5 working days of our receipt of your request.

5. Warranty and liability

5.1 Nothing in this Agreement shall be construed as restricting or excluding our liability for death or personal injury resulting from our negligence or for fraud. Nothing in this agreement affects your statutory rights as a consumer.

5.2 Our liability to you under this Agreement shall not exceed the amount paid by you for the Service.

6. General

6.1. You must be at least 16 years old to use the Service.

6.2 No waiver or any amendment to these terms shall be effective unless in writing and signed by both you and us.

6.3 A person who is not a party to these terms may not enforce any of them under the Contracts (Rights of Third Parties) Act 1999.

6.4 If any dispute arises out of these terms we will both attempt to settle it by mediation in accordance with the Centre for Dispute Resolution (CEDR) Model Mediation Procedure.

6.5 This Agreement shall be governed by the laws of England and we both agree to submit to the exclusive jurisdiction of the English Courts.

Code of conduct

Be a good forum citizen

• The value of a forum is in the exchange of personal ideas, opinions and experiences. However, please post these courteously and with respect. Don’t use language that could be offensive to others (even if it is not to you), don’t make abusive or threatening comments in general or about other people or organizations, or incite hatred or violence.
• Do not use the forum to advertise other products, services (except those available from Mind Tools) or websites through links or otherwise. For the sake of clarity, this means that no URLs other than those linking to other parts of www.mindtools.com may be included in posts (including in your signature.) This prevents the common practice of forum link spamming, which can make a forum unusable.
• All postings must be legal. This means that, amongst other things, they should not include pornography or obscenity, anything to do with the trade of illegal drugs, or infringe copyright.
• Any messages you post should be relevant to the forum and to the topic, and be of potential interest to others. Only start a new thread if you have checked that there isn’t a suitable one already. Do not post the same material to multiple forums. Read relevant parts of the forum before posting and do not repeat things that have already been said. Moderators reserve the right to move postings to a different thread if they think the posting would sit better there.
• Do not impersonate others, or give the impression that you are an employee of or spokesperson for any organization, including Mind Tools, if you are not.
• Please use full sentences (avoid ‘text’ language), and don’t type ENTIRELY IN CAPITALS as it is hard to read and gives the impression you are shouting.

Our Rights

• Mind Tools reserves the right to remove any postings it considers inappropriate, without explanation, at any time.

• Mind Tools also reserves the right to change this Code of Conduct at any time, and so forum members are advised to check it regularly to ensure that they still comply.

• Mind Tools is not responsible for anything posted to online forums accessed from www.mindtools.com, and can accept no liability arising from postings.

• Anyone found in breach of these rules may be unsubscribed from the Club, at which point that month’s subscription will be returned to them.

Stay safe

• Mind Tools recommends that you do not divulge personal information such as your e-mail address, postal address, phone number or credit card details on the forum. If you do so, it is entirely at your own risk.

• To avoid any issues of child safety, you may not use this forum if you are under 16 years of age.

• It is your responsibility to evaluate any advice or suggestions made in this forum before acting on it. Any actions you take as a result of anything you read in the forum are entirely your responsibility.
